Defense of Marriage Act Gets Boost from U.S. House Legal Counsel

Washington, DC - Liberty Counsel applauds the U.S. House of Representatives' choice of legal counsel to defend the federal Defense of Marriage Act (DOMA). The U.S. House leadership hired Paul Clement of King and Spalding, LLP to defend DOMA. Clement, the former Solicitor General under President George W. Bush, is a skilled advocate who has argued many times before the United States Supreme Court.

President Obama instructed Attorney General Eric Holder to no longer defend DOMA, which affirms the definition of marriage as the union of one man and one woman for purposes of federal law. Even before the Department of Justice ceased defending DOMA, it was providing only a weak defense.
Now that Paul Clement is on the case, DOMA will get the defense it deserves.

The U.S. House is proposing to use money allocated to the Department of Justice to pay for the defense. Liberty Counsel had already filed amicus briefs in some of the challenges to DOMA and will continue to provide briefs on all challenges to DOMA.

Rather than weakening the defense of DOMA, President Obama's decision to not defend the law has opened up the opportunity for Paul Clement and his team to provide a real defense. I have had the pleasure of working with Paul Clement on the Ten Commandments cases when I argued at the U.S. Supreme Court. He is a skilled advocate and the right choice to defend DOMA. Liberty Counsel will continue to provide amicus briefs and other legal defense to defend the Defense of Marriage Act."
