Virginia Attorney General Abandons Natural Marriage


Richmond, VA—Virginia’s new Attorney General, Mark R. Herring, after only two weeks in office, announced today that he will not only abandon the defense of the Commonwealth’s marriage amendment, but he will also file a brief against it. The Virginia marriage amendment was passed by a vote of 57 percent of Virginians in 2006. It affirms marriage as the union of one man and one woman.

Like President Obama and Eric Holder, the Virginia Attorney General says his view on same-sex marriage has evolved. While state senator in 2006, Herring voted for the marriage amendment.

“Marriage predates government and civil authorities. Virginia’s marriage amendment did not create marriage. It simply affirmed marriage as the union of one man and one woman,” said Mat Staver, Founder and Chairman of Liberty Counsel. “Marriage was not created by religion or government and is ontologically a union of one man and one woman. For any court or civil authority to think it has the authority to redefine marriage is the height of hubris. Deconstructing marriage will hurt children and society,” Staver said.

Attorney General Mark Herring is using the Supreme Court’s decision on the federal Defense of Marriage Act (DOMA) as the basis of his argument. “Today’s legal battle over deconstructing marriage is the equivalent of the 1973 abortion decision in Roe v. Wade. Deconstructing marriage will divide our country and, like the abortion decisions, puts the selfish desires of adults over the needs of children,” Staver said.
